These Terms of Service (“Terms”) govern your use of https://www.clevelandheath.com (the “Site”), operated by Cleveland-Heath (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful purposes only. You agree not to use the Site to violate any law, infringe anyone’s rights, transmit spam or malicious code, attempt to gain unauthorized access to the Site or its systems, or interfere with its normal operation.
Inquiries, quotes, and requests
Forms on the Site let you contact us and request information, catering, private events, and gift cards. Submitting a form does not create a contract or a binding order, and any pricing or availability shown or discussed is not final until we confirm it with you directly. We may decline or cancel a request at our discretion.
Reservations and bookings
Table reservations are handled through our reservations partner, OpenTable, and are subject to OpenTable’s own terms as well as ours. A reservation is a request until it is confirmed. We hold reserved tables for fifteen minutes after the booking time; if you are running late, a quick call helps us hold your table longer. Please cancel through your OpenTable confirmation or by phone at least four hours in advance, and at least twenty-four hours in advance for parties of six or more. We may release, decline, or cancel a reservation at our discretion, including for no-shows.
Intellectual property
The Site and its content, including text, graphics, logos, images, and layout, are owned by Cleveland-Heath or its licensors and are protected by intellectual-property laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, or redistribute the Site’s content without our permission.
Accuracy of information
We work to keep the Site accurate and current, including our menus, hours, and pricing, but we do not warrant that all content is complete, correct, or up to date. Content is provided for general information and may change without notice.
Third-party links and services
The Site may link to or embed third-party websites or services we do not control, such as OpenTable and Google Maps. We are not responsible for their content, products, or practices, and linking does not imply endorsement. Your use of a third-party service is governed by that party’s own terms.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Cleveland-Heath and its owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Cleveland-Heath from any claims, damages, or expenses arising out of your misuse of the Site or your violation of these Terms.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Site after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Illinois.
